摘要
对体育法地位的科学界定,是体育法最基本的理论问题。传统部门法的划分标准忽视了以增进公众福利为价值目标的体育法的社会性趋向,以致体育法的部门法地位的合理性被怀疑。体育法调整对象的确定性、二元规则的调整模式以及调整方法的激励性特点说明,独立部门体育法有其存在的意义。
To define the role of departmental law in sports law is the theoretical basis for studying sports law. The traditional classification of departmental law neglects social function of sports law in promoting the public welfare so that the role of deparmental law has been questioned. The defining of grulative objects, the system of dual regulation and the characteristics of encouraging of regulative methods could prove that departmental law is significant.
