摘要
法治体育是当前政治话语在体育领域的集中体现,将法治引入到运动员非体育道德行为的治理中是基于政治、文化等多方面诉求的考量,面对德治无法对运动员非体育道德行为进行有效治理的困境,指出法治是最佳的治理方式。在此基础上,从宏观与微观相结合的角度,对运动员非体育道德行为法治治理途径展开探索,确定治理途径包括以下4个方面:1)宏观引导,确定专项立法;2)稳步推进,有效突破;3)因地制宜,实现法治体育本土化;4)重在实施,培养法治自主意识。阐明运动员非体育道德行为治理中法治的实施问题,为体育领域法治的进一步开展提供借鉴。
Legal sports is current political discourse in the field of sports embodies, the rule of law to introduce athletes non sport moral behavior of governance is based on considerations of political foundation, cultural origin, the reality demands. Because we cannot carry out the effective governance of the plight ofathletes non sport moral behavior in the face of the rule of virtue, this paper points out that the rule of lawis the best way of governance. Based on the combination of macro and micro perspective, athletes nonsport moral behavior rule of law governance way to begin to explore, we ultimately determine the governance approaches include the following four aspects ： 1） Macro guidance, determine the special legislation;2） Steadily,and gradually expand the rule of law category; 3） Adjust measures to local conditions, to realize the rule of law sports localization 1） Interest focuses on the implementation, training the independentsports consciousness of rule of law. The study clarifies the implementation of the rule of law in the management of non-sports moral behavior,and provides a reference for the further development of the rule oflaw in the field of sports.
