摘要
计算机量刑作为当前一种新兴的量刑模式与方法,不仅有助于提高量刑效率,还能在一定程度上防止法官滥用刑罚的自由裁量权,同时也有助于排除那些影响法官公正量刑的人为因素和政治因素,最终推进我国量刑指导制度的逐步建立。然而计算机量刑的出现并非意味着它可以完全取代法官而成为独立的量刑主体,从其实际功能而言,计算机量刑仅仅是法官裁量刑罚的辅助工具或者只是人民法院办公自动化的一种尝试。
Sentencing by computer, which is a new kind of sentence that can be used as the current sentencing patterns and methods, helps to improve the efficiency of sentencing, to a certain extent. It can both prevent the abuse of the sentence judge discretion to exclude those effects and contribute to a fair sentencing judge human factors and poetical factors, and ultimately promote China＇s sentencing guidance system being established. The eassistant means of punishment or just an attempt to court office automation.
