摘要
"集体"导向的公共卫生干预理念主张在公共健康和公众福利受到威胁时公民的基本自由权利应受到必要的限制,而"个人"导向的公民自由理念主张在俗世社会中任何行动的权威只能来源于有行为能力的道德主体的同意。两种观念的对立反映出在公共卫生领域中长期存在的公共健康与个人自由之间的张力。在公共卫生领域,我们应该将公共健康放在优先位置,同时应该用"人的生命尊严"作为边界限制。
The concept of ＂Community-oriented＂ public health interfere suggests that the basic civil liberty should be necessarily restrained when public health and general welfare are at risk. On the contrary, the con- cept of ＂Individual-oriented＂ civil liberty suggests that in the secular society, the authority of every movement in the society should come from the agreement of the moral subjects. These two concepts reveal the tension between public health and civil liberty in the field of public health. In the area of public health, we should put public health in the first place, and at the time, we should use the ＂dignity of human life＂ as the negative restraint.
