摘要
新刑法对罚金刑的大量制定与罚金刑在司法实践中出现诸多问题之间的矛盾日渐显著,研究罚金刑的传统范式(工具理性)在面对上述矛盾时并不能给出令人满意的解决方案。因此,有关罚金刑的价值理性应当引起重视,以刑罚价值的视角对罚金刑进行考量是一条有益的理路。研究表明,对罚金刑进行刑罚价值层面的研究给立法抑或司法都会带来新的启示。
The contradiction between legislation on the penalty of fine in the new criminal law and the mounting problems derives from the fact that its judicature practice has become more and more severe.However,the traditional research method of the penalty of fine（instrumental rationality） cannot provide satisfactory solutions.Therefore,considering the penalty of fine from the perspective of value of punishment,which is a beneficial approach,should be highly regarded.It has also been proved by research that this new approach has significant inspiration for both legislation and judicature.
