摘要
本文基于文化传统与改革趋向的视角,比较和分析了德国和美国公立高校和教师法律关系。德国是政治性社会中的行政制衡体系,美国是自治性社会中的平等契约关系。其发展总趋势是:公法人化是其高等学校改革发展的必然方向,教师应成为具有专业自由权利的专门化职业,具有专业自由权利的教师和作为公法人的公立高校在聘任制度下必然建立起平等的契约关系。
With institution insight into the cultural traditions and reform trends in Germany and America. A comparative study is conducted on legal relations between the faculty and the public higher education Germany is the political community in the administrative system of checks and balances, and America is the self-governing society with the contractual relationship of equality. They have the common tends:the public higher education institutions must to be a public legal personality and the teaching of faculty will be a specialized academic profession with more and more freedom and rights. So, under the employment system, the faculty, who have specialized rights and freedom, will be equal to the public higher education institutions as the bilateral contact defined.
