摘要
一个加害行为违反或者没有违反相关管制规范的事实,对于侵权行为的判定会产生什么样的影响?从公法与私法相互关系的视角来思考可以深化对此问题的理解。管制规范中的防止侵害型规范,是以保护他人利益为目的,对侵权行为法具有直接意义。在侵权行为法的适用过程中,此种类型的管制规范作为私法规范的一种补充,其评判与裁判功能将有机会得以显现,并主要体现在侵权裁判的论证负担上。
Should the judgement towards tortious conduct be on the basis of fact that a particular harmful conduct violates applicable regulative rules？ The problem can be analyzed in -depth from the perspective of the interaction between public and private law. Regulative rules, which protect the public interest by prohibiting harmful conduct, have the direct influence on the tortious conduct judgment. During the application of the tort law, regulative rules, which supplement the private law, will increasingly be applied to the evaluation and adjudication, with primary impact on the burden of argumentation with respect to determination of a tort.
