摘要
文章从经济学角度出发,通过期限收益曲线模型和诺德豪斯的基本模型,对专利最优保护期限进行了分析;并针对我国具体专利保护的实际情况,在诺德豪斯基本模型和期限收益曲线模型的基础上放宽了假设条件,得出了专利保护期限应当差异化并可适当延长的相关结论。
This paper analyzes the protection of the optimal patent length from the angle of ecomomics with the help of the length benefit curve and the Nordhaus basic model. Aiming at the actual facts of patent protection in China, the paper assumes certain conditions based on the Nordhaus basic model as well as the length benefit curve of patent and comes to the conclusion that the patent length should be differentiated and lengthened accordingly to some extent.
