摘要
向外转让专利权是技术出口的一种形式,它是技术转让的重要内容之一。我国目前有关技术转让的立法问题,如法律法规之间的相互冲突、软件转让定位不明、技术出口管理及限制权利人滥用权利之规定的不完善等,对我国向外转让技术带来了一定的消极影响。为此,我们必须补充、修改、完善现有的相关法律制度,努力构建统一的技术转让法,以推动我国专利技术出口在良性的轨道上发展。
Transferring patent rights to foreigners is one of the forms of exporting technology, which constitutes the main content of technology transfer. The legislative lactmae of the current system on technology transfer, such as the conflicts among the different laws and regulations, the implicit orientation of transferring software, imperfect stipulations on management of technology export and limitations of abuse of rights by the rightholders, etc., engender certain negative effects on transferring technology to foreigners. Therefore, we should supplement, revise and consummate the existent legal system related to technology transfer and try to enact a uniform technology transfer to drive the patented technology transfer to develop in an affirmative way.
