摘要
专利制度赋予发明者在一定期限内享有对发明的独占排他性权利,以便其被广泛利用,从而促进技术的进步、产业的发展。经过专利制度的若干经济分析可以看出,专利制度为社会的发展和人类的进步发挥着一定的促进作用,但是,专利制度赋予专利权人一定的独占权,其制度本身也因这种独占存在着一定的内在弊害,必须调和专利制度与社会规范意识之间的冲突和差异,从而将其独占所产生的弊害降低到最小程度。
The patent system endows the inventor with exclusive rights to the benefit the inventions bring about so that it may be fully used in the future in the advancement of technology and industry.Therefore,the patent system is positively contributive to social development and the progress of the humanity in general.Meanwhile,however, because of the exclusive ownership the system entails,it is also defected to some degree with internal flaws.
