摘要
行政合同虽然在我国行政管理实践中客观存在,但对于行政合同的理论研究及其相关法律制度的建设均呈现明显的滞后性。在法学界对于行政合同及其制度建设还存在较大的学术争议。文章在肯定行政合同的前提下,就关于行政合同的若干存在学术争议或者不同见解的基本理论问题作了概况性阐释,并提出了作者的见解或观点。
Although administrative contracts is an objective existence in China, but theoretical studies for administrative contracts and its constructions of relevant legal systems are obviously lag behind, there are still existed biggish academic disputes within the law circles. Under the preconditions of affirmation of administrative contracts, the article gives general explanations on some fundamental theoretical problems which existed academic disputes or different opinions as well as offered the authors own viewpoints.
