摘要
意思实现在我国法上属于一种意思表示,不同于狭义上的默示的承诺。意思实现属于要约、承诺的缔约方法,“以要约和承诺以外的方法成立的契约”的命名值得商榷。意思实现制度能够周到地保护受约人的合法权益。
