摘要
随着经济的发展,在交易实战中成长起来的新型消费者权利不断地拓宽着法律的认知视野。从对消费者深度人性关怀的角度,探讨消费者商品交易反悔权应该保持天然的合同自治性,还是提升为法律强定权;其权利范域是慎囿于个别经营,还是朝向全部消费方式。
With the development of the economy, the legal cognition field of vision is enlarged by new consumer's rights which arise from the trade, such as the rights of rescission, which gave us deep thought. Which is the better between contract rights and legal rights to the consumer's rights of rescission? Should the rights he applied in the field of some respective contract or that of all sales ? Some tentative ideas are given.
