摘要
对中国现行消费者保护立法体系进行回顾,中国未来消费者保护法的立法构想,应当考虑采用系统化、一体化的立法模式,拟含消费者政策(法)、消费者合同(法)、消费者安全(法)三部分;中国未来消费者保护法的理论创新应从立法指导思想及性质定位上探讨;制度创新拟确立消费者反悔权及“强行持续”制,建立经营者惩罚性赔偿制、强制缔约义务的规定及强化对不公平条款控制的制度。
China's Consumer Protection Law should be systemized and integrated with three parts, consumer policy law, consumer contract law and consumer security law. The theory of the law should be innovated in guiding idea and quality orientation and its system innovation should establish a system insuring the right of the consumer for rescission and of "compelling lasting", set up the system of punishment compensation and propelling concluding contract from and by the proprietor, and of strengthen the control of the unfair articles.
