摘要
患方选择何种途径解决医疗纠纷取决于对自己成本投入和预期收益的比对。影响成本投入的因素主要是纠纷解决途径的选择,再则是医疗纠纷的性质。降低患者在司法途径解决医疗纠纷中的交易成本,将有利于引导患者理性合法地参与解决医疗纠纷。
which kind of way the patient choose to solve medical dispute depend on comparison between the cost and the pros- pective earnings. The factor influencing the cost to be invested is mainly the choice of the way to solves the dispute, moreover the na ture of the medical dispute. Reducing the cost invested in the medical dispute course throuth judicial way will help to lead the patient to participate in solving the medical dispute with legal means.
