摘要
对中国区际法定夫妻财产制进行比较研究,为解决中国区际法定夫妻财产制法律冲突准备条件,成为当前我们所面临的一项重要任务。通过对中国区际法定夫妻财产制进行比较研究发现,中国区际法定夫妻财产制在类型、结构、立法指导思想、具体规定上都存在诸多差异,但同时各地法定夫妻财产制又有一定的相似之处。今后两岸四地应以这些共同之处为基础,采取有效的措施以解决中国区际法定夫妻财产制法律冲突。
Conducting the comparison research on the legal husbands and wives property system in the intersectional area of China, and this can prepare conditions for solving the conflicts of it, has become an important task that we currently face. Through carrying on the comparison research on the legal husbands and wives property system in the intersectional area of China, we can find that there are many differences in the type, the structure, the legislation guiding thought and the specific stipulation of the legal husbands and wives property system in the interseetional area of China, but at the same time each place legal husbands and wives property system also has certainly similarity. In future, four places of mainland and coast, taking these things in common as the foundations, should take effective measures to solve the conflicts of the legal husbands and wives property system in the intersectional area of China.
