摘要
登记是几类重要动产物权的公示方法,其主要功能在于公示动产物权的变动。动产物权登记的效力也有生效要件主义和对抗要件主义之别,我国现行立法采取的是一种折中主义或者说是一种混乱的立场,物权法应当将之统一为对抗要件主义。登记对抗力的本质是未经登记的物权变动在当事人之间业已完全有效成立,在对第三人的关系上亦非绝对无效,仅该受让物权的当事人不得对抗善意第三人主张物权变动的效力而已。对于第三人,应采限制说。我国未来的物权法或者民法典物权编应当统一动产登记的公信力规则,即统一赋予动产登记以公信力。
Registration, with its main function of proclaiming the transference of the right over movables, is the very method of proclaiming the right over several kinds of important movables. There are two schools of thought on the effect of registration of the right over movables: one regards it as an essential factor to validate the transference, called the theory of effectiveness; the other as an essential factor to confront the third party in good faith,called confrontation;sin. However, China legislation adopts an eclectic stance.or say,a mixed stance, which, in my opinion, should be integrated as the latter theory in China real law, The essence of the effect of confrontation resulting from registration is that in registration transference of real right, parties concerned can counter the third party, even the third party in good faith; while in non-registration transference of real right they can' t, although the transference has been validly done. and has certain effect on the third party. This task of unification should be fulfilled by the law of real right or China civil code in the future,and also, the effect of public credit of registration of movables should be endued an prescripted.
