摘要
美国环境保护自1970年代以来取得了巨大进展,但也激起了强大的“绿色反弹”,其中包括环境保护在美国法院所遭到的严峻挑战。这种挑战集中表现在有关起诉资格、产权和司法审查的重大法律之争上。环境保护之所以在法院遭到如此严峻的挑战,固然有很多原因,但真正深层次的原因在于环境保护主义的权利观。这种权利观所要加以限制的不仅仅是私人产权,而且是人类的权利,因为从生态系统的角度来看,大自然不只是可供人类利用的资源,她也应该有她自己的权利。
The United States has witnessed great achievements in environmental protection since the 1970s, but has also encountered powerful “green backlash” in recent decades. Not surprisingly, environmental protection has faced with serious challenges at American courts. These challenges focus on the major legal issues such as lawsuit qualification, property rights, and judicial review. The reasons for such legal battles may vary from case to case, but the underlying one at a deeper level is the environmentalist view of legal rights, which holds that certain restrictions should be imposed not only on private property rights, but also on the rights of the mankind. From the ecological perspective, Mother Nature cannot be simply seen as resources to be used by human beings. Mother Nature should have her own rights as well.
