摘要
物权的取得与变动,应当通过可取信于社会公众的外部表现形式,就不动产而言,此种公示方法应为不动产物权登记。而且,为保护交易安全的需要,应当采取实质主义登记的立法模式。然而,由于社会生活的现实需要,有必要承认非依法律行为变动的不动产物权无需登记即可发生效力。在不牵涉第三人的情况下,新权利人可以享有对不动产的自由支配。但如果第三人的利益牵涉其中,不动产物权登记制度仍然应当发挥重要的作用。
The acquisition and transfer of property right shall be reflected in a public manifestation which might be relied upon by the social public. As for real estate property the public manifestation shall be achieved through registration. For the purpose of transaction protection a material registration system shall be adopted for real estate property. However the transfer of real estate property arising from non-legal transaction shall be effective without registration. The new property owner shall have the right to hold an estate in fee. Nevertheless the registration system for real estate property shall also play an important role under the circumstances that a third party's interests are involved.
