摘要
行政事实行为的出现源于行政职能的变化。行政职能从以管理为主转变为以服务为主 ,导致行政事实行为这种新的行为型态产生。行政事实行为较多表现为行使职权过程中的侵权行为 ,急需对之进行规范。基于此 ,从行政复议、国家赔偿、行政诉讼等方面 。
The coming of administrative factual act(AFA) originated from the variation of administrative function. Because of changing into serving from administration, it caused the existence of the new style of AFA. AFA embodies mainly tort in performing administrative power, it is in dire of normalizing the AFA. Basing on this, an elementary suggestion is put forward to establish remedy system of AFA in administrative review, administrative compensation and administrative action.
