摘要
针对国有经济占控制地位的关系国民经济命脉和国家安全的行业以及依法实行专营专卖的行业,《反垄断法》第七条规定一方面要对其合法经营进行保护,另一方面要对其控制。在对本条的具体理解上存在不同的意见。本文界定了特定行业的范围,并从法律解释和国家干预理论等角度对该条进行了具体的分析,以期为本条的适用提供理论支持。
