摘要
近年来,我国文化娱乐领域流量资本盛行、负面事件频发,引起社会高度关注。政府介入文化娱乐领域治理能有效维护社会公平、避免资本无序扩张,但介入过多也会限制该领域的发展。通过梳理文化娱乐领域整治案例,发现当前“政府介入下的流量模式”存在“重事后,轻事前”、管理被动、“弱协同”、行业协会作用未能充分发挥、制度层面处罚规则模糊不清等问题。基于此,本文提出采用协同治理理念,协同社会力量共同开展全过程监管,把控政府介入该领域的边界等对策建议。
In recent years,the prevalence of capital operation and the frequent negative events in China’s cultural entertainment field have aroused high social concern.The government intervention in the governance of cultural entertainment field can help to effectively maintain social equity and avoid the disorderly expansion of capital,but too much intervention will also limit the development of this field.This paper sorts out cases in this field,and finds some existing problems related to the capital operation mode under government intervention,such as passive management resulting from the emphasis on ex post and neglect of ex ante,insufficient role of industry associations caused by weak coordination,and unclear punishment rules at the institutional level.Based on this,we put forward some countermeasures and suggestions,like using the concept of collaborative governance to carry out whole-process supervision together with social forces so as to control the boundary of government intervention in this field.
