摘要
涉及区域合作的规范性文件,需要区域内各行政区协作制定。协作制定存在实践基础,但将面临区域性事务的管辖权问题、区域管理机构的法律地位问题以及不同行政区的规范性文件管理制度不协调、协作制定缺乏统一的程序规则等问题。协作制定的价值在于,有利于形成统一的"规范域",也有利于区域利益的实现。在路径选择上,包括由区域内各行政区相关行政机关联合制定、由区域管理机构与各行政区相关行政机关联合制定、授权区域管理机构直接制定等三种模式。
Normative documents involving regional cooperation need to be formulated by all administrative regions in the cooperation region.There is a practical basis for collaborative formulation,but it will face the problems of jurisdiction of regional affairs,the legal status of regional management organizations,the disharmony of normative document management systems in different administrative regions,and the lack of unified procedural rules for collaborative formulation.The value of collaborative formulation lies in that it is conducive to the formation of a unified“normative domain”and the realization of regional interests.In terms of path selection,there are three modes:jointly formulated by the relevant administrative organs of each administrative region,jointly formulated by the regional management organization and the relevant administrative organs of each administrative region,and directly formulated by the authorized regional management organization.
