摘要
法学的科学性探究基于法学与科学的定义明晰,鉴于中西方历史上存在不同的法学研究传统,分别从中西方不同语境下探讨法学及科学的定义以及二者关系,最终可得出这一问题的回答。在西方视阈下选择极具影响力且具有产生先后顺序的古典自然法学派和实证法学派进行探究,在中国视阈下选择古代和当代极具鲜明特点的两个时期进行探究。
Research on the scientific nature of law is based on a clear definition of law and science. Given the different legal research traditions in the history of China and the West, we will explore the definitions and relationships between law and science in different contexts, and ultimately an answer to this question. The classical natural law school and the positive law school with great influence and production order are chosen to explore under the western perspective, and the two periods with distinctive characteristics of ancient and contemporary are chosen under the Chinese perspective.
