摘要
党的十一届三中全会以来的四十年,我国最高立法机关特别是全国人大常委会经过了艰辛的科学立法探索,对科学立法概念逐渐从立法环节、程序、立法体系、立法技术、立法方法等方面的含义,转到其最实质性最关键性的内容,即科学立法的核心在于立法要尊重和体现社会发展的客观规律、尊重和体现法律所调整的社会关系的客观规律以及法律体系的内在规律。科学立法方面四十年来取得了辉煌的成绩,但也有很多值得进一步探索和深化的方面。科学立法是个永恒的话题,是一个不断完善的过程。只要我们坚持科学精神,不断解放思想,持之以恒地探索,就一定能使科学立法工作迈上新的台阶。
Over the four decades since the Third Plenary Session of the 11th Central Committee of the CPC,the top legislative organ of China,i.e.the National People’s Congress,and in particular its Standing Committee have arduously explored the way to ensure that the legislation is sound.Consequently,the notion of sound legislation has undergone a gradual change:its focus is shifted from such aspects as the legislative links,procedures,system,techniques to the most substantial facet,hence the recognition that the key to sound legislation lies in respecting and reflecting the objective law governing the social development,the social relations regulated by the law,and the inner logic of the legal system.Over these 40 years,extraordinary achievements have been made in sound legislation,but there are still many issues worthy of further efforts.Sound legislation is a permanent topic and a process of continuous improvement as well.As long as we stick to the sound principle,emancipate our mind continuously,and work ceaselessly for new discoveries,we will surely scale new heights in making good laws.
