摘要
随着“互联网+”的出现和发展,中国网民数量不断攀升,一种以用户打赏为基础的“打赏经济”应运而生。随着网络直播市场的不断扩大,在“打赏经济”繁荣的同时许多新问题应运而生,其中最为突出的便是如何定义网络直播打赏行为的法律性质。为了保障网络直播市场的平稳运行,治理网络直播打赏乱象,在学术界需要研究和探讨网络直播打赏行为属于民法典中何种类型,由此提出相对应的解决手段。目前在我国,网络打赏行为性质不明,监管机制缺失,对于问题的处理手段也十分有限,导致此种问题在司法实践活动中难以进行有效的监督。因此,认清网络直播打赏行为的性质,建立强有力的直播打赏监管机制,出台相关法律法规是目前规制直播打赏市场的有效措施,也是实现互联网精细化的有效手段。
With the emergence and development of “Internet+”, the number of netizens in China keeps rising, and a kind of “tipping economy” based on users’ tipping comes into being. With the continuous expansion of the network broadcast market, many new problems arise at the same time as the prosperity of “tipping economy”, among which the most prominent is how to define the legal nature of the network broadcast tipping behavior. In order to ensure the smooth operation of the network broadcast market and control the chaos of network broadcast tipping, it is necessary to study and discuss what type of network broadcast tipping behavior belongs to in the Civil Code in the academic community, so as to put forward corresponding solutions. At present, the nature of the network appreciation behavior is unclear, the lack of regulatory mechanism, and the treatment of the problem is very limited, which leads to this problem is difficult to effectively supervise in the judicial practice. Therefore, recognizing the nature of live broadcast tipping behavior, establishing a strong supervision mechanism for live broadcast tipping, and issuing relevant laws and regulations are effective measures to regulate the live broadcast tipping market, as well as effective means to realize the refinement of the Internet.
