摘要
随着国际贸易往来的不断深化,国际关系的不断发展,知识产权国际规则呈现出新的发展趋势。现有的国际知识产权规则主要是TRIPS协议相关内容,但随着自贸协定的开展,诸如CPTPP协议和USMCA协定的出现,国际知识产权保护已经呈现出了一种超TRIPS的趋势。在这种新趋势下,对于正在努力建设知识产权大国的中国而言,不仅要遵守和接受知识产权的国际规则,将知识产权保护与国际规则接轨,未来也要秉持“人类命运共同体”这一理念主动创新和建设新知识产权国际规则。
With the deepening of internationaltrade and the continuous development of international relations, theInternational Rules of Intellectual Property Rights (IPR) show a new trend ofdevelopment. The existing internationalintellectual property rules are mainly related to TRIPS agreement, butwith the development of free trade agreement, such as CPTPP agreement and USMCAagreement, the international intellectual property protection has shown a trendbeyond TRIPS. In this new trend, for China, which is striving to build anintellectual property power, it is not only necessary to abide by and acceptthe international rules of intellectual property, but also to bring theprotection of intellectual property into line with the international rules, inthe future, we should take the initiative to innovate and construct newinternational rules of intellectual property in accordance with the concept of“Community of human destiny”.
