摘要
当前立法工作中存在着一定的缺陷,如农民权利缺乏保护、法律难以得到普遍认同、法律形式上的西方化、法律外在于乡土社会、法律法规呈现明显漏洞等,造成了法律进入农村的困难。农村法制建设需要加强立法工作,提高立法质量。法律必须赋予农民同等的权利,必须尊重传统文化,必须得到人们内心的接受。立法要关注社会发展的不平衡和不同质,并在实际工作中不断完善现有的法律法规和法条。
There are many defaults in legislation. The peasants rights lack laws protection. The laws were difficultly approved by the whole society. The westernization of legal form make the laws exist out of the earthbound society, Laws and regulations present obvious loophole, etc. Thus, it is difficult for the laws to enter into the rural areas. Constructions of Legal Systems need to enhance the legislation, and improve its quality. Laws must offer the equal rights to the peasants, respect the traditional culture and be accepted by people from the bottom of heart. Legislation should focus on the disequilibrium of social development, and complete constantly current laws and regulations in practice.
