摘要
跨地区劳务派遣的工伤保险比一般劳务派遣更为复杂,加之法律规则的缺位,现实中存在很多问题,包括工伤保险参保率低、工伤保险待遇差异造成的同工不同待遇问题以及未参保时工伤待遇标准以及先行支付义务主体的确定等问题。对此目前主要有三种解决路径:1.法律解释;2.用工单位缴纳工伤保险费用;3.用人单位缴费工伤保险费,明确规定跨地区劳务派遣参保地、工伤待遇标准。其中第3种解决路径是当下最为合理的选择。
Compared with general labor dispatching,work-related injury insurance in trans-regional cases is more sophisticated. Besides,there’s a lack in regulations about this at present,thus leading to a series of problems in reality,such as low rates of buying work-related insurance,different treatments between the workers from different standards and different places,the difficulty to determine the treatment standards and the institution that shall pay for the insurance treatment. There are mainly three solutions,which are explanation of the current law,letting the employers pay the bill for its own employees or employers affording the expenditure with clear stipulations on the place to buy the insurance and treatment standards. Among them,the third solution is the most appropriate one.
