摘要
随着信息通讯技术对社会各领域影响的深入,互联网法院作为司法主动适应互联网发展大趋势的一项重大创新制度,自设立即引起世人的瞩目。然而,检索分析北京、广州与杭州互联网法院设立至今的全部裁判文书,不难发现,在对互联网法院诉讼便捷、司法高效过多渲染之下,却忽略了互联网法院审判发展的瓶颈,甚至淡漠了互联网法院应承担的专业化审判的司法责任。破解互联网法院审判受制于现行民事诉讼法所确立的诉讼制度与程序规则困境的关键,在于以'网上案件'超越物理空间地域的本质特征为基础,走出互联网法院系集中管辖'网上案件'特殊法院的误区,使互联网法院回归审判专业性案件专门法院的定位。
With the deepening effect of Information and Communication Technology on each field throughout the society,as an initiative attempt to keep up with the innovative trend of Internet by China’s judicial system,The Internet Court,has obtained massive attention ever since its establishment.Nonetheless,according to the retrieval and analyze work upon all the judgments from Beijing,Guangzhou as well as Hangzhou Internet Court,it appeared that under the exaggerate propagation of the convenience and efficiency on this new court,it however overlooked its bottleneck in judicial development tendency,and even deviated from the professional duty which the Internet court should undertake.The key to cracking the dilemma,which the Internet court is constrained by current litigation system and procedure rules,is to get rid of the misunderstanding that Internet court has the only jurisdiction over all the online-related litigations,with whose essential characteristic in reality is already beyond traditional physical space restriction.In that way could the Internet court return to its original orientation,which has the emphasis trail-focus upon professional and specialized litigations.
