摘要
互联网法院的探索与实践已历经数年,“网上案件网上审”的初期功能也已基本实现。随着全国法院信息化的推进和在线诉讼的普及,互联网法院由此开始面临转型升级与功能进化的压力。未来可赋予互联网法院专门法院的地位,同时对专门法院的内涵进行扩张解释,纳入功能专门化类型,将互联网法院界定为专门探索法院。此举可进一步发挥互联网法院的积极作用,化解改革创新与法律系统稳定性之间的张力,遏制各地各级各类法院偏离审判业务的创新冲动对法律系统稳定国民行为预期之功能的破坏,谨慎实现法律系统的自我再生产。
Several years have been witnessing the exploration and practice of Internet courts,the preliminary function of“online case,online trial”has been basically realized.With the promotion of the informatization of domestic courts and the popularization of online litigation,Internet courts have been being faced with the pressure of transformational upgrade and functional evolution.In the future,Internet courts are likely to function as specialized courts.Meanwhile,the connotation of specialized courts should be expansively interpreted to include the type with specialized function,Internet court is suggested to be defined as specialized courts for exploration.This would facilitate the positive function of Internet courts,resolve the tension between reform and innovation and the stability of the legal system,restrain the devastation on the legal system’s function of stabilization and the expectation of citizen’s behavior by the innovation impulse of any court deviating from trial business,and carefully realize the self-reproduction of the legal system.
