摘要
对仲裁裁决书草案的复核审查(Scrutiny)制度是国际商会仲裁院(ICC)的首创,ICC1975年仲裁规则第21条和1998年新仲裁规则第27条都对此进行了规定。该制度的建立和发展对我国仲裁机构有关制度的建设具有参考和借鉴意义,本文拟对该制度进行探微,希望对完善我国仲裁机构仲裁裁决复核审查制度有所裨益。
The review and security system of draft arbitral awards,initiated by ICC,is set forth both in the article 21 of ICC Rules of Arbitration 1975 and article 27 of the new Rules of Arbitration1998.The establishment and improvement of the system is of great significance for the relating system construction in china.By making a tentative research on the system,this paper works to give suggestions for improving the review and security system in china.
