摘要
随着我国《物业管理条例》的颁布和实施,物业管理在法制化进程上又迈向新的一步,但该条例对业主委员会的法律地位规定尚未明确。业主委员会既非法人,也非社会团体等经济组织,其权利来源于全体业主的授权,是业主大会的执行机构,代表全体业主实施业主对物业的自治管理,应确立业主团体的概念以理顺物业管理外部关系,参考现代企业制度中董事薪酬制保障业主委员会对内责任能力。
The issue and implementation of the Regulation of Estate Management is a great leap in the field of estate management, however, the legal status of the Estate Owner' s Committee is not clearly defined in the regulation. The Estate Owner's Committee is neither a corporate body nor a social organization. Its rights derive from the authorization of all the owners and exercise autonomous management of the estate on behalf of all the owners. The role of the owner' s organization should be clearly defined.
