摘要
理论界对业主委员会的法律性质与民事主体定位存在激烈争议。立法与司法之间更显张力,从《物业管理条例》《物权法》到《民法典》,国家性立法均对业主委员会的主体性质与诉权"缄默不语",最高人民法院的观点也反复矛盾,而地方立法实践则呈现多元化特征。从团体人格、非法人组织等民事法律主体的基础理论来说,业委会具备成为民事主体的资格,属于《民法典》上的非法人组织。
There are fierce disputes in the theoretical circles concerning the legal nature of proprietor committees and its position of civil subject.There is even more tension between legislation and judiciary.The state legislations including Property Management Regulations,Property Law,and Civil Code,"keep silent"over the subject nature and litigation right of the proprietor committee.The viewpoints of Supreme People’s Court on the issue have also been repeatedly contradictive while the local legislative practice presents the characteristics of diversification.In view of the basic theory of civil legal subjects like group personality and unincorporated organization,the proprietor committee is qualified to be a civil subject and belongs to the unincorporated organizations in Civil Code.
