摘要
认罪认罚从宽制度是指在刑事诉讼中,由实体与程序保障、鼓励的犯罪嫌疑人、被告人自主自愿承认罪责、接受实体惩罚,从而予以从宽从简处理处罚的一系列法律规则的集合。认罪认罚从宽制度适用广泛,无论是从法的应然状态还是实然状态看,该制度都有其存在并发展的时代背景与理论根基。完善刑事诉讼中认罪认罚从宽制度是我国深入推进"以审判为中心"的刑事诉讼制度改革的重要一环。目前,我国司法资源分配不合理、诉讼效率亟待提高等问题在司法改革的洪流中日益凸显,"案多人少"的司法困境依然存在,在此背景下,坚持问题导向,合理界定"认罪认罚从宽"的理论来源和现实意义,深入探究改革进程中的诸多制度难题无疑具有划时代的意义。
The system of leniency on admission of guilty and acceptance of punishment is the collection of a series of legal rules,which are guaranteed by the entity and procedure,encouraged by the entity and the procedure,and accepted by the defendant voluntarily and punished by the entity. The system is applicable to a wide range of systems,both from the state of the law or the state of reality,the system has its existence and development of the era background and theoretical foundation. It is an important part of our country to promote the reform of the criminal procedure system of " taking the trial as the center" in improving the leniency system of recognizing and pleading guilty in criminal proceedings. At present,the problem of unreasonable distribution of judicial resources and urgent need to improve the efficiency of litigation in the torrent of judicial reform has become increasingly prominent, " More cases,fewer investigators," the judicial predicament persists,in this context,adhere to the problem-oriented,it is undoubtedly of epoch-making significance to reasonable definition of " Leniency on admission of guilty and acceptance of punishment " theory sources and practical significance and deeply probe into the problems in the process of reform.
