摘要
澳门博彩批给制度实行多年,已经显示出缺乏应变能力等缺点,亦产生了第三人通过与持牌公司合作曲线进入澳门博彩市场以及过分依赖第三方贵宾厅等问题。澳门博彩批给制度即将到期,应当借此机会对其进行检讨。改革的一个思路是以准照制代替批给制,即不再由政府限制批给数量和期限,以便澳门更有能力应付日益激烈的国际竞争。只要设计得当,准照制并不产生鼓励博彩业无序发展的后果。另一个思路是保留批给制,但对批给期限、数目及方式进行一定程度的改良,允许政府在一定时期过后对市场状况进行评估,决定是否以及采取何种方式增加批给。后一思路属于过渡性方案,具有一定程度的局限性。
After more than a decade of operation, the concessionary system of Macao’s gaming industry has shown quite a few shortcomings such as lack of flexibility and resilience, and the third parties entering Macao’s gaming market by collaborating with one of the concessionaires or establishing a VIP room. As the current concessionary period is approaching the end, Macao government should consider conducting a thorough review of its concessionary system and making changes to it. One option of the reform is to replace it with a licensing system which will not restrict the number of concessionaires or the duration of concession. The licensing system will be very helpful for Macao to cope with the increasingly fierce international competition as it is more flexible than the current system. It will not bring about disorderly development of the gaming market as long as it is properly designed. The other option is to retain the basics of the concessionary system while making changes in the number of concessionaires, the period of concession and the method of selecting concessionaires. The new system should have enough resilience in principle. For instance, it allows the government to decide whether or not to increase the number of concessionaires in a certain period based on the market evaluation. The latter option, however, is not as ideal as the former one since it will not solve the major problems caused by the concessionary system.
