摘要
基本医疗服务国家程序给付义务对应于健康权的程序保障功能,具有社会法和客观法性质,是基本医疗服务国家给付义务的基本构成要素。基本医疗服务国家程序给付义务的适当履行,是人人享有基本医疗服务的保障。现行基本医疗服务国家给付实践中,存在给付程序缺位和错位导致的公权力行使恣意、给付对象基本医疗服务获得感不足等问题。应构建国家给付基本医疗服务的义务性程序、保障获得基本医疗服务的权利性程序,以及基本医疗服务给付过程中的参与程序等为基本要素的国家给付程序体系,以完善基本医疗服务给付制度和确保该制度的可操作性。
The state’s procedure payment obligation to basic medical services corresponds to the procedural guarantee function of the right to health, and has the nature of a social rule of law. It is the basic component of state’s payment obligation to basic medical services. Basic medical service payment practices need to strengthen procedures, but there are insufficient procedures in the payment of basic medical services in China. The system for state’s procedure payment obligation to basic medical services should include the following three aspects, such as obligation procedural norms for the state to pay for basic medical services, right procedures norms for citizens to obtain basic medical services, and participation procedure specification in the basic medical service payment process.
