摘要
明确非物质文化遗产的产权及其归属是对其保护、传承、开发治理的前提条件和重要保证。为此,在回顾已有关于非物质文化遗产产权及其治理研究状况的基础上,首先对非物质文化遗产产权的内涵和属性进行梳理,并分析非物质文化遗产所具有的客体对象及权利属性的特征;然后分析非物质文化遗产的复合产权属性,涉及经济资本、政治资本、文化资本、社会资本和象征资本这五大权属,及其隶属主体情况;最后结合现实,运用复合产权的思路,从复合产权各权属主体行为、非物质文化遗产类型、非物质文化遗产发展阶段三方面提出相应治理对策。
To clarify the property rights and ownerships of intangible cultural heritage is the prerequisite and important guarantee for its protection, inheritance and development. For this purpose,on the basis of reviewing the existing researches on intangible cultural heritage property rights and their governance,the connotation and attribute of intangible cultural heritage property rights are summarized, and the characteristics of the objects and power properties of intangible cultural heritage are analyzed. Then, the composite property rights of intangible cultural heritage are analyzed, which involve five ownership rights of economic capital,political capital, cultural capital, social capital and symbolic capital, as well as their subject status. Finally, based on the reality and the idea of the composite property rights, this paper puts forward the corresponding countermeasures from the three aspects of the behavior of the subjects of the composite property rights, the types of intangible cultural heritage and the development stages of intangible cultural heritage.
