摘要
本轮金融风暴引起了对信用评级机构国际监管的格外关注,乃至G20华盛顿峰会决定将信用评级机构纳入全球监管范围。信用评级机构的国际监管存在国内立法不足制约国际监管、国际监管基础制度的不完善,以及有效的国际监管合作制度缺失等问题。为应对金融危机,各国政府加强对信用评级机构的监管,政府间相关监管合作也取得了一定进展,国际组织也相继颁布了一些新规定。对信用评级机构的国际监管,应该对评级机构恰当定位,从评级程序与信息披露入手,科学设计评级制度;改革评级收费模式,建立评级机构法律责任制度,确保国际监管合作及其有效性。
Since the worldwide financial crisis has highlighted the question of the global supervision and regulation of credit rating agencies,the G20 Washington Summit decided to put them under global supervision and regulation.The deficiency or absence of domestic regulation abated the efficient regulation of international markets,and also there exist institutional defects in the rating process and the rating models,as well as conflict of interest inherent in the charging modes.The governments have taken some steps to enhancing the supervision of credit rating agencies in the process of getting over the global financial crisis,and some progress has been made in the cooperation of supervision and regulation between governments.International organizations,such as IOSCO and FSF, have updated or renewed their documents relating to the practice of credit rating agencies. The authorities should give the rating agencies a proper weight about their role in the financial markets for regulation purpose.The basic measure should consist of proper process and sufficient and timely disclosure,avoiding the conflict of interests inherent in the charging modes.Precise legal obligation should be imposed so as to perfect supervision and regulation of credit rating agencies internationally.
