摘要
中华人民共和国1954年宪法(简称五四宪法),是新中国第一部社会主义类型的宪法。中国共产党是五四宪法的制定者和执行者,因此,新民主主义的宪政思想及其指导下的宪法性文件,成为五四宪法制定的直接来源。
The May Fourth Constitution of the People's Republic of China in 1954 is the first socialist constitution of China.It fully inherited and developed the earlier constitutional jurists and theorists' constitutional thought.Among them,Marx,Engels and other classical writers' constitutional ideas formed the base theory of the May Fourth Constitution.On the basis,it borrowed and absorbed the thought of Sun Yat-sen's constitutional thoughts of five powers charter,power sub-scholarship theory and direct civil rights.And the new-democratic constitutional ideas and the constitutional documents under their guidance became the direct sources of the May Fourth Constitution.
