摘要
国际法院审理的澳大利亚诉日本南大洋捕鲸案是一起受到国际社会关注的案件。案件起因是日本在国际捕鲸委员会颁布商业捕鲸禁令后,仍通过"日本特许南大洋捕鲸第二阶段研究方案",以科学研究为名在南大洋海域捕获、击杀和加工处理鲸鱼。澳大利亚遂以日本违反《国际捕鲸管制公约》及其附件为由向国际法院提起诉讼。国际法院通过对《国际捕鲸管制公约》的解释最终支持了澳大利亚的诉讼请求。国际法院的判决对条约的解释、鲸类的国际保护乃至相关科学与法律问题的理论与分析都有了新的发展。
The Whaling in the Antarctic case heard by the International Court of Justice is one of the most remarkable cases in the international community.Australia instituted proceedings against Japan,alleging that Japan's continued pursuit of a large-scale program of whaling under the Second Phase of its Japanese Whale Research Program under Special Permit in the Antarctic was in breach of obligations assumed by Japan under the International Convention for the Regulation of Whaling.At last,the Court upheld the plea made by Australia.The case provides a up-to-date assessment of the contribution of the International Court of Justice to the development of treaty interpretation,protection for whales,as well as some scientific and legal issues.We aim to bring inspiration from the commentary.
