摘要
如何实施上海自由贸易试验区的政府监管,如何建立适合上海自贸试验区政府监管的基本模式、形成监管体系,不仅关系到自贸区的正常运营,也关系到自贸区的健康发展。本文从正确理解上海自贸区"境内关外"含义;正确处理上海自贸区"半市场化"的特征;正确贯彻国际惯例,实施政府监管创新几方面着手,分析如何显现政府监管综合效应,以及使得上海自贸区的政府监管能"可复制"、"可推广"。
How to implement government regulation in the Shanghai(pilot)Free Trade Zone?How to establish a basic mode suitable for government regulation and shape a regulating system in the Free Trade Zone?These issues are important not only to the normal operation of Free Trade Zone,but also to its healthy development.This article proceeds from discussing such topics as comprehending the concept of Domestic Tariff Area,correctly dealing with the characteristics of semi-marketization of the Free Trade Zone,and rightly adopting international practice and implement governmental regulation revolution.Through these discussions,it presents the way to realize the comprehensive effect of government regulation and to enable the governmental regulation mode of Shanghai Free Trade Zone to be copied and widely applied.
