摘要
经济法关乎"三大关系"的调整,对于国家治理至为重要。提升国家治理能力,需要加强经济立法,完善国家经济治理的体系框架,解决立法的系统性和协调性问题;需要在经济法领域界定国家的经济职能和经济职权,明晰国家经济治理的权力基础,有效保障市场主体的经济自由权和经济发展权;需要提升各类经济法主体的能力,实现多元主体参与的有效经济治理。上述的立法路径、分权路径和能力路径密切相关,是提升治国能力应当特别关注的经济法路径。
Economic law which concerns the regulation of Three Relationships is a crucial issue of the na-tional governance. The improvement of national governance needs us to strengthen the legislation inEconomic law, improve the framework of national economic governance, and solve the systemic and co-ordination problems of legislation. It also requires us to clearly define economic function and econom-ic authority in Economic law, clarify the bases of power in national economic governance, and effec-tively guarantee market subject's right to economic freedom and economic development. What's more,promoting the ability of all bodies recognized by economic law and achieving the goal of effective eco-nomic governance which pluralist bodies can take part in are also needed. The economic law routesstated above which includes legislation strengthening, power separation, and the capability enhance-ment are closely related with each other, and they should be pay special attention when consideringthe improvement of the national governance.
