摘要
现行法律对不动产登记资料查询制度的规定较为模糊,实践操作的问题较多,在不动产登记资料的性质、查询主体、查询方式和查询范围、查询与共享的区别四个方面均存在疑难问题亟待解决。不动产登记脊料不属于政府信息,应当遵循分类查询和有限公开的原则;基于不动产登记资料的性质,应当对登记资料的查询主体进行必要限缩,包括权利人、利害关系人和有关国家机关,而且权利人仅指不动产登记簿上记载的不动产登记物权人,不含隐性共有人;至于利害关系人范围的界定则应该利用目的解释的方法,界定申请人与所查询不动产登记资料的关系;不动产登记资料的查询制度应在维护交易安全和保护权利人隐私之间寻求平衡,严格限制“以人查房”。此外,国家部门间的共享和登记资料的查询也有必要予以廊清,二者的内涵外延不同,在主体、性质、方式和作用等方面均有显著差异。
The current law stipulates the rules governing the registration of real estate registration data. There are many problems in practice and the institutionalization and standardization need to be strengthened. In view of this,this paper selects four difficult issues such as the nature of the real estate registration data,the subject of inquiry,the query method and the scope of the query,and the difference between query and sharing, and hopes to outline the system outline of the registration of real estate registration data to clarify the understanding.Misunderstandings can help the practice and legislation of real estate registration data query system. Through the examination of theoretical disputes and practical operations,the author believes that: real estate registration data does not belong to government information, should follow the principle of classified inquiry and limited disclosure;based on the nature of real estate registration data, we should make necessary restrictions on the subject of registration information Including the rights holders,interested parties and relevant state agencies. In addition, the right holder refers only to the right holder of the real property registration recorded in the real estate register,and does not include any hidden co-owner;the definition of the scope of the interested party should use the method of purpose interpretation to define the registration information of the applicant and the real estate inquired.Relationships;The enquiry system of real estate registration data should seek a balance between the maintenance of transaction security and the protection of the privacy of right holders, and strictly limit the "people-to-people check-ups".In addition,the sharing of national departments and the query of registration data also need to be clarified. The connotation and extension of the two are different, and there are significant differences in the subject,nature,mode,and role.
