摘要
前科消灭制度为犯罪人提供一种激励机制,有利于预防犯罪人再次犯罪,并使其能够真正回归社会。因此前科消灭制度被许多国家普遍采用。而我国刑法至今尚未确立这一制度。本文对前科、前科消灭的定义和法律后果进行了阐述,并在介绍国外各国前科消灭制度的基础上,提出构建我国前科及前科消灭制度的具体设计方案。
The elimination of previous conviction provides an incentive mechanism for the perpetrator,which is benefit to prevent criminals from commiting again,help them return to society.So the elimination of previous conviction is widely adopted by many countries. Criminal law of China has not yet established this system.This paper focuses on the definition and the legal consequences of previous conviction and elimination of previous conviction.After the introduction of foreign elimination of previous conviction the writter provides the specific design of the system of elimination of previous conviction and previous conviction.
