摘要
电子文件证据与传统证据相比较,只是载体方式不同,在证明机制方面并无区别。但由于数字技术的特性,电子文件具有显而易见的不稳定性,从而导致电子证据的证明力较弱。笔者认为,现在的电子商务认证技术只是保证了商务主体和电子文件的真实性,但不能防止电子文件被人为删除的情况发生,所以应当建立电子文件的实时备份制度,以此增强电子证据的证明力,使这种新的证据形式发挥应有的作用。
The article will discuss two problems: firstly,the e-records are not a new kind of proof,they have the same prov ing system as the traditional ones. For the reasons well known to us, the e-reco rds are of obvious instability and subject to modification and deletion .As a result, the probative force of them are very weak. The other important pro blem we are caring about is how to improve the probative force of the electronic records and make them play their role.
