摘要
农药使用者就农药事故责任和损害赔偿与农药生产者、经营者产生的争议,是目前困扰基层农业部门的突出问题。本文根据农业执法实践,结合行政法理论,借鉴交通事故责任认定方法,通过对农药事故行政鉴定进行探讨,从制定调查处理程序、明确责任判定标准、规范书写鉴定书三个方面对农药事故行政鉴定提出完善建议,以期更好地维护农民合法权益,定纷止争。
Dispute in pesticide accident liability and damages between pesticide users,producers and operators,is a prominent problem for agricultural sector.Based onagricultural enforcement practice,combined with the theory of administrative law and learning from traffic accident responsibility identification method,this paperexplored the cases of the pesticide accident administrative identification.To better safeguard the legitimate rights and interests of farmers,the article offered some comments on establishing identification procedures,defining responsibility and standardizing testimonial writingand put forward some sound proposals.
