摘要
中止犯是指在故意犯罪过程中,行为人自动放弃犯罪行为或自动有效地防止犯罪结果发生的一种犯罪形态。中止犯的特征有:时间性、自动性、有效性。共同犯罪中止的有效性以整个共同犯罪是否最后达到完成状态来确定。危险犯行为人防止危害结果的发生应是实害犯的中止。
Discontinued criminal is the criminal who gives up the criminal behavior or prevents the criminal effect self-motionly. The features of discontinued crime are; timeliness, self-motion, and effectiveness. The effectiveness of the joint offence depends on whether the joint offence finishes its action. The doer of the dangerous offence prevents the take place of the criminal results, which can be regarded the break off of the actual damage offence.
