摘要
各国由于刑事政策不同,累犯概念、累犯的构成要素和对累犯的处罚措施均存在重大的差别。我国刑法对累犯采取主观与客观相统一的累犯概念,将累犯分为一般累犯和特别累犯,对累犯的处罚均采从严制裁的政策。借鉴国外的累犯制度,我国累犯制度在未成年累犯、法人累犯、累犯的处罚等诸多方面均有进一步完善的必要。
There are differences in notion,type,elements and the punishment of the recidivism in the foreign crime laws.In the crime law of the P.R.C,the notion of recidivism is mixed.Recidivism was partitioned two types,the general recidivism and the especial recidivism.And the punishment rule is the aggravation.The policy of recidivism of the crime law of the P.R.C should be amended about the young person recidivism,the artificial person recidivism and the punishment rule.
