摘要
基于环境处罚的功能定位,本文论证了环境处罚的理论标准,特别是考虑到不同情形的环境罚款标准。通过对国家重点监控企业的实证分析发现,处罚标准与重点监控组合共同起到了较好的威慑作用,但环境罚款及其他处罚措施在责令企业整改方面效果并不乐观。政策启示包括:首先,提高环境处罚标准确定的科学性,有效的罚款威慑必须与企业的利润挂钩;其次,提高政府环境处罚的执行能力和效率,加大对环境监察和执法方面的人力财力投入;最后,环境处罚的执行还需其他政策相互配合,需注重环境管理和治理的制度体系建设,提高政策合力。
By combing the function of environmental punishment and the existing problems in China,this paper demonstrates the theoretical standard of environmental punishment,especially considering the environmental fine standards in different circumstances.Through the empirical analysis of national key monitoring enterprises,it is found that the punishment standard and the key monitoring play a good deterrent effect together,while environmental penalties and other penalties are not effective in ordering enterprises to rectify.The policy implications are shown as follows.First of all,the scientific nature of environmental penalty standards should be improved,for effective deterrence must be linked to the profits of enterprises.Secondly,the execution and efficiency of the government’s environmental penalties should be improved,as well as the input of human and financial resources in environmental monitoring and law enforcement.Finally,the implementation of environmental punishment needs complementary policies,the focus on constructing the system of environmental management and governance,and the improvement of the resultant force of policies.
